Terms of Service
Effective 2026-05-28. These Terms govern all purchases made on or after the effective date.
1. Acceptance
These Terms of Service ("Terms") are a legal agreement between you ("you", "buyer", "user") and The Algo Catalog, a sole proprietorship operating under the trade name The Algo Catalog ("we", "us", "our"). By clicking the purchase button, completing checkout, or downloading any product distributed from this site, you confirm that you have read, understood, and agree to these Terms, the Privacy Policy, the Refund Policy, and the Risk Disclosure, each incorporated here by reference. If you do not agree to any of these documents, do not purchase or download.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding contract in your jurisdiction. By purchasing, you represent that the information you provide at checkout (including name, email, and billing address) is accurate, that you are buying for your own use and not on behalf of an undisclosed third party, and that the law in your jurisdiction permits you to receive and use the Product.
3. What you are buying
You are buying a single-user, non-transferable, non-exclusive, perpetual license to use one specific RealTest strategy file and the accompanying documentation, video, or scripts bundled with it (collectively, the "Product"). The license applies to the copy of the Product delivered to you at the time of purchase. The Product is delivered as-is and no updates or patches are included with your purchase.
4. What you are NOT buying
You are not buying: (a) personalized investment advice; (b) a financial recommendation suited to your specific situation; (c) any guarantee, projection, or promise of future returns; (d) entry into a registered investment-advisory or commodity-trading-advisory relationship; (e) a brokerage account, custodial relationship, or any service that places trades on your behalf. The Algo Catalog is not a registered investment adviser, broker-dealer, futures commission merchant, commodity trading advisor, or any other licensed financial professional. The Product is impersonal software, not advice.
5. License grant and restrictions
Subject to your compliance with these Terms, we grant you a non-transferable, non-exclusive license to install, run, and modify the Product on any number of computers that you personally own or control, solely for your own trading, research, or educational use. You may not, and may not permit any third party to: (a) resell, redistribute, sublicense, lease, or otherwise transfer the Product or any substantial portion of it; (b) publish the Product or substantial portions of it to public repositories, forums, file-sharing services, or social media; (c) use the Product to offer paid signals, paid managed-account services, or any derivative commercial offering, without our prior written permission; (d) remove or alter any copyright, license, or attribution notices contained in the Product files; (e) use the Product in a manner that violates any applicable law or regulation. Violation of this Section may result in revocation of your license without refund.
6. Updates
The Product is sold as-is. We do not issue updates or patches as part of your purchase, and we are under no obligation to maintain the Product or to ensure it continues to function with future releases of RealTest, Norgate Data, broker APIs, or any other third-party software or data source. You may continue using the copy you purchased indefinitely under the license described above.
7. No warranty
THE PRODUCT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF RESULTS. We do not warrant that the Product will achieve any particular trading performance, will produce results consistent with the published backtest, will operate without errors or interruptions, will be free of vulnerabilities, or will remain compatible with any third-party software, data source, or broker. You assume all risk arising from your use of the Product.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE ALGO CATALOG BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST PROFITS, TRADING LOSSES, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE PRODUCT OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE PRODUCT OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE PRODUCT IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.
9. Indemnification
You agree to defend, indemnify, and hold harmless The Algo Catalog from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Product; (b) your breach of these Terms; (c) your violation of any law or regulation; or (d) trading or investment decisions you make using the Product. This obligation survives termination of your license.
10. Service availability
We do not guarantee uninterrupted availability of this website or of the download infrastructure used to deliver the Product. If a download link expires before you use it, contact us and we will reissue. We are not liable for delays or failures caused by third-party services (including Stripe, Resend, DigitalOcean, or your email provider) or by force-majeure events beyond our reasonable control.
11. Taxes
The displayed purchase price is exclusive of any applicable sales tax, value-added tax (VAT), goods-and-services tax (GST), or similar transactional tax. Where we are required to collect such tax, it will be added at checkout. You are solely responsible for any income tax, capital-gains tax, or other tax arising from your use of the Product or from trading activity undertaken using it.
12. Refunds
Refund eligibility is governed by the Refund Policy, which is incorporated into these Terms by reference.
13. Termination
We may terminate or suspend your license at any time, without notice, if you breach these Terms (including any restriction in Section 5). Termination does not entitle you to a refund. On termination, you must cease using the Product and destroy all copies in your possession. Sections 4, 7, 8, 9, 11, 14, 15, and 16 survive termination.
14. Governing law
These Terms and any dispute arising out of or related to them are governed by the laws of the State of Utah, United States, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
15. Dispute resolution and class-action waiver
Any dispute, claim, or controversy arising out of or related to these Terms or the Product shall be resolved by binding individual arbitration administered by American Arbitration Association (AAA) under its then-current Consumer Arbitration Rules. Arbitration shall take place in Orem, Utah, or remotely by mutual agreement. The arbitrator's decision shall be final and binding. You and The Algo Catalog each waive any right to (a) a jury trial and (b) to participate in any class, collective, or representative action. Notwithstanding the foregoing, either party may bring an individual action in small-claims court for any dispute within that court's jurisdiction.
16. Severability and waiver
If any provision of these Terms is held unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to enforce it later.
17. Entire agreement
These Terms, together with the Privacy Policy, Refund Policy, and Risk Disclosure, constitute the entire agreement between you and The Algo Catalog concerning the Product, and supersede all prior agreements, communications, or understandings.
18. Changes to these Terms
We may update these Terms. The effective date at the top of this page will change. Material changes apply only to purchases made on or after the new effective date; your existing license remains governed by the version of the Terms in effect when you purchased.
